Virginia Retail Tobacco Permit Overview

Beginning October 1, 2026, Virginia businesses that sell covered tobacco, nicotine, vapor, and related products must hold a Retail Tobacco Permit issued by the Virginia Alcoholic Beverage Control Authority (Virginia ABC).

The permit applies to cigarettes, smokeless tobacco, nicotine products, vaping devices, and liquid nicotine, with or without nicotine, plus blunt and hemp wraps, glass pipes, and related components and accessories. Requirements and fees are being finalized by Virginia ABC, so specifics may be updated.

Moving from the Tax Department to Virginia ABC: Under HB 308 / SB 620, oversight of tobacco and vapor retailers transfers from the Virginia Department of Taxation to Virginia ABC. Beginning October 1, 2026, the new Virginia ABC Retail Tobacco Permit takes the place of the Department of Taxation's liquid nicotine and vapor products license approach. Some Virginia Tax requirements still apply separately, such as the cigarette resale exemption certificate and the tobacco products tax. Who needs a Virginia Retail Tobacco Permit?
Any business that sells covered tobacco, nicotine, or vapor products to consumers in Virginia, including convenience stores, gas stations, grocery stores, smoke and vape shops, internet retailers, and multi-location operators. The requirement takes effect October 1, 2026.
When does the Virginia tobacco permit requirement take effect?

How much does a Virginia Retail Tobacco Permit cost?
The application fee is $300 for existing Virginia ABC alcohol licensees and $400 for retailers without an ABC alcohol license. Fees are set by Virginia ABC and are subject to change.
Which products require a Virginia tobacco permit?
Covered products include cigarettes, electronic cigarettes, disposable and refillable vapes, e-liquid and liquid nicotine, nicotine vapor products, heated tobacco, smokeless tobacco, nicotine pouches such as ZYN and VELO, hookah, blunt and hemp wraps, and glass pipes. Cigars and pipe tobacco are exempt.
Does the Virginia Retail Tobacco Permit allow me to sell hemp, CBD, or cannabis products?
No. The Retail Tobacco Permit covers tobacco, nicotine, and vapor products only. Hemp, CBD, cannabis, and marijuana products are regulated separately in Virginia by agencies such as the Virginia Department of Agriculture and Consumer Services (VDACS) and the Virginia Cannabis Control Authority, and are not authorized by this permit.
I'm an out-of-state internet retailer. Do I need a Virginia license to ship to Virginia customers?
Generally, yes. Under Virginia law, sellers of nicotine and vapor products must be licensed whether they are inside or outside the Commonwealth, so an out-of-state or online retailer that sells covered products to Virginia consumers typically needs Virginia licensing. Remote online sales of cigars or pipe tobacco to Virginia consumers require a separate remote retail seller license. These requirements originated under the Department of Taxation and, along with retail tobacco licensing, are transitioning to Virginia ABC's permitting system effective October 1, 2026. Federal law (the PACT Act) also imposes registration, age-verification, and reporting requirements on remote sellers of tobacco and vapor products. Because these rules are detailed and in transition, contact us and we will confirm exactly what applies to your business.
I already have the Virginia Tax liquid nicotine and vapor products license. Do I still need this?
Yes. Under HB 308 / SB 620, oversight of tobacco and vapor retailers is moving from the Virginia Department of Taxation to Virginia ABC. Beginning October 1, 2026, retailers need the Virginia ABC Retail Tobacco Permit, which takes the place of the old Department of Taxation liquid nicotine and vapor products license. Does the ABC permit replace all of my Virginia Tax obligations?
No. The Virginia ABC Retail Tobacco Permit is separate from certain Virginia Department of Taxation requirements that still apply, such as the cigarette resale exemption certificate and the tobacco products tax. We can help you understand which requirements apply to your business.
I already have a Virginia ABC alcohol license. Do I still have to submit ownership documents?
Yes. The Retail Tobacco Permit is a separate application from your alcohol license, so your ownership documentation must be provided to Virginia ABC again. The upside is that existing Virginia ABC alcohol licensees qualify for the reduced $300 application fee. We reuse what we can and prepare the rest for you.
What if my ownership has changed since my last Virginia ABC filing?
This is a common and important issue. Virginia ABC requires licensees to report changes in officers, directors, members, or stockholders owning 10 percent or more within 30 days, and certain ownership changes, such as a sale or adding a partner, can automatically terminate the existing license. If your ownership, membership, or officers have changed since you last updated Virginia ABC and it was not reported, applying for the tobacco permit can surface that gap and your business could be in violation. We help you identify and correct these issues before they become a problem.
My lease was renewed or changed since my ABC license was issued. Is that a problem?
It can be. Virginia ABC needs to see that the applicant controls the premises, usually through the lease. If your lease has been renewed or updated and is now signed by a different party, or a different business entity holds it than the one on your license, that mismatch can hold up your tobacco permit and may point to a change Virginia ABC was never told about. We review your lease against your license and ownership records to catch and resolve these gaps before you apply.
Do I need a separate permit for each store location?
Yes. A separate Retail Tobacco Permit is required for every retail location.
Is employee training required for the permit?
Yes. On the initial permit application, the applicant must attest that employees have received training on ID checking, placement of signage, prohibited acts, and penalties. Whether the same attestation will be required at annual renewal has not yet been confirmed by Virginia ABC. Who issues the permit and runs the background checks?
The Virginia Alcoholic Beverage Control Authority (Virginia ABC) issues the permit through its VAL system and runs the required background checks. These typically apply to owners, corporate officers, directors, managers, partners, members, and stockholders owning at least 10 percent. We prepare and coordinate the paperwork for you.
How long is the Virginia tobacco permit valid?
The permit is valid for 12 months and must be renewed annually.
